Ramesh Sippy Property Dispute Reaches Mediation in Bombay High Court | Mumbai News

MUMBAI: The Bombay High Court has sent a dispute between Bollywood film director Ramesh Sippy and his nephew, along with others, over a SoBo property and other issues to be resolved amicably after both sides agreed to mediation.
The Sippy family agreed to mediation by former HC Judge, Justice S J Kathawalla, to try and see if all disputes between them can be settled.

On January 6, the HC adjourned an appeal filed by Ramesh Sippy to allow both sides to consider mediation as an option. A division bench of Justices B P Colabawalla and F P Pooniwalla, in its order in January, then requested the mediator to file his report in court within four weeks. If the mediator requires further time, the parties are free to seek an extension. The HC posted the matter to February 14 for directions.
Ramesh Sippy and his nephew Sunhil Ajit Sippy, along with 12 others, were at loggerheads following his father’s demise.
On January 13, the HC recorded that both sides have come to a pro-tem agreement, including that Shaan and Sameer Uttamsingh, grandchildren of G P Sippy, would not part with possession, sell, or create any third-party right in a residential property at Altamount Road, Mumbai. Ramesh Sippy, who filed an appeal against an order in a suit that he filed for the administration of his late mother’s estate, also agreed not to part with a residential flat in the same building on the same floor.
The flat has two parts, with share certificates of each half in different names, one in Ramesh Sippy’s name and the other in the names of Shaan and Sameer. The flat, however, is one single unit, the HC noted.
The parties agreed that Shaan and Sameer can renovate the whole flat without changing its layout. They cannot carry out any structural changes without court permission. Ramesh Sippy has directed blockbuster hits such as Sholay. The HC heard counsel Shanay Shah and solicitor B Munim & Co for Ramesh Sippy, and Archit Jayakar with Jayakar and Partners for the grandchildren of G P Sippy.
Ramesh Sippy said he is the only surviving son of his father, the late G P Sippy, among five siblings. Last April, the HC dismissed Ramesh Sippy’s interim relief plea over the fifth-floor flat and other assets. He then filed an appeal, which the HC appeal bench is now hearing. There were several rounds of litigation among the family over the property.
The HC said, “If for any reason the mediation fails, this court will then consider’’ other reliefs sought by Sippy.
