Mumbai: The Bombay High Court on Friday granted pre-arrest bail to a man accused of rape and aggravated sexual assault on a minor under the Protection of Children from Sexual Offences Act, 2012 (Pocso), after the girl’s father said the FIR was lodged due to a “misunderstanding”.
The accused, Yash Konde, sought bail through lawyers Sudeep Pasbola and Piyush Toshnival, saying the case was false and he feared arrest. The girl, aged 7 years, was allegedly going to school, and the accused was the driver of the schoolbus, according to the chargesheet filed in April 2024.
The father of the girl, however, through his lawyer Naagesh Khedkkar, submitted an affidavit before Justice Manish Pitale on Friday, stating that the allegations were made against the accused due to a misconception. The daughter was “actually found to be suffering from a urine infection, and when the report was received from the doctor,” the error came to light. The father also made the same statement before a magistrate earlier, noted the HC, and thus granted anticipatory bail to the petitioner, saying the prosecution would have difficulty proving its case even if the matter went to trial.
The bail was set at a bond of Rs 50,000, and the man was directed not to tamper with witnesses or evidence. tnn
