Bombay high court orders Navi Mumbai housing complex to allow dog feeding by resident

Mumbai: Justice Girish Kulkarni and Justice Advait Sethna of the Bombay high court on Tuesday, in an interim order, directed Seawoods Estates Ltd in Navi Mumbai not to prevent any domestic help from visiting the apartment of a resident to discharge their regular duties. The high court also directed Seawoods Estates and other petitioners not to obstruct municipal authorities from taking lawful steps or the resident, Leela Verma, from feeding street dogs at the designated places.
Verma’s lawyer alleged that her fundamental rights were being violated as her domestic staff was not being allowed to enter the premises for work. The high court said if that was true, “we may observe that the petitioners cannot resort to and not respect and breach the fundamental rights guaranteed to the other residents of the buildings merely because they are feeding the dogs, who belong to the said area or have territorial affinity”.
The society has challenged the validity of Rule 20 of the Animal Birth Control (ABC) Rules of 2023, which requires residents’ welfare associations (RWAs) and apartment owners associations (AOAs) to feed stray animals on their premises. The rule also requires local body representatives to provide space and make arrangements to feed community animals.
The high court questioned the locus of petitioners’ in pursuing the petition and said “if there is any grievance of (Seawoods Estate) on any issue of feeding the dogs or any palce of feeding”, it can file proceedings before a designated authority’ to find out suitable mechanism to feed strays.
The high court adjourned the matter to Feb 4.
